License Agreement

License Agreement for the equasys Image Test Collection and the equasys Video Test Collection:

IMPORTANT - READ CAREFULLY

This license statement and limited warranty constitutes a legal agreement ("License Agreement") between you ("Licensee"), either as an individual or a single entity, and equasys GmbH ("equasys") for the Licensed Material, including any software, media, and accompanying online or printed documentation.

"Licensed Material" means any still image, film or video footage, audio product, visual representation generated optically, electronically, digitally or by any other means, including any negatives, transparencies, film imprints, prints, original digital files or any reproduction thereof.

BY DOWNLOADING, INSTALLING, VIEWING, DECODING, COPYING, OR OTHERWISE USING THE LICENSED MATERIAL, YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THE LICENSE AGREEMENT.

Licensee has the perpetual, worldwide, non-exclusive, non-transferable, non-sublicensable right to use the Licensed Material for hardware and software development tests, for product tests and product demonstrations, for exhibitions and promotions.

Licensee has the right to alter, crop, manipulate, convert and create derivative works of the Licensed Material.

Licensee may store the Licensed Material in a digital library, network configuration or similar arrangement to allow the Licensed Material to be used by all members of one working group, but under no circumstances may the Licensed Material ever be used by more than 10 users.

Licensee may not sell, license or distribute the Licensed Material or any derivative work.

Licensee may not post the Licensed Material online in a downloadable format.

LIMITATION OF WARRANTIES AND LIABILITY:

THE LICENSED MATERIAL IS PROVIDED "AS IS" WITHOUT REPRESENTATION, WARRANTY OR CONDITION OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED REPRESENTATIONS, WARRANTIES OR CONDITIONS OF MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. EQUASYS DOES NOT REPRESENT OR WARRANT THAT THE LICENSED MATERIAL WILL MEET THE REQUIREMENTS OF THE LICENSEE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EQUASYS OR ITS SUPPLIERS BE LIABLE FOR ANY GENERAL, PUNITIVE, SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE LICENSED MATERIAL, EVEN IF EQUASYS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, EQUASYS' ENTIRE LIABILITY UNDER ANY PROVISION OF THIS LICENSE AGREEMENT SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY THE LICENSEE FOR THE LICENSED MATERIAL.
